League City Police Complaint

League City residents Randy and Rachael Hall assert they were harassed and unjustly arrested at their home earlier this month by League City police officers.

A prominent developer and his wife are demanding answers and a public apology from the city after being arrested in their home in front of their children, handcuffed, photographed, fingerprinted and detained for more than eight hours in the city jail over a fender-bender in a gym parking lot on Sept. 2.

I’m glad the daily news is looking into how abusive and damaging the police and jail system can be. It’s sad that it takes it happening to a rich white couple for it to make front page news when it happens all the time to poorer people who dont have political connections. Every step of the process, from being arrested, to being booked and jailed to then having to deal with the chargers, is abusive, obtuse, expensive, and stacked against the average citizen. The entire idea of “presumed innocent” is a joke. But, hey, at least this kind of abuse is being exposed.

In my opinion, for the police to state that "It's very common for police to make arrests over misdemeanors like this." indicates to me that this police policy is a serious problem that should be immediately solved. It should not be "very common for police to make arrests over misdemeanors like this."

When I first read about these gender-benders in a gym I thought it was serious crime. It sounded like this couple was part of an organized crime family or members of the street gang Gender-Benders that were paroled from prison. I thought they deserved to be treated like criminals because if you go around bending genders you deserve to be put in jail.

Article 15.26 of the Texas Code of Criminal Procedure states, in part: ..."If the officer does not have the warrant in his possession at the time of arrest he shall then inform the defendant of the offense charged and of the fact that a warrant has been issued. The arrest warrant, and any affidavit presented to the magistrate in support of the issuance of the warrant, is public information, and beginning immediately when the warrant is executed the magistrate's clerk shall make a copy of the warrant and the affidavit available for public inspection in the clerk's office during normal business hours..." This is contrary to the Hall's account of their arrest.

In executing a warrant of arrest, it shall always be made known to the accused under what authority the arrest is made. The warrant shall be executed by the arrest of the defendant. The officer need not have the warrant in his possession at the time of the arrest, provided the warrant was issued under the provisions of this Code, but upon request he shall show the warrant to the defendant as soon as possible. If the officer does not have the warrant in his possession at the time of arrest he shall then inform the defendant of the offense charged and of the fact that a warrant has been issued. The arrest warrant, and any affidavit presented to the magistrate in support of the issuance of the warrant, is public information, and beginning immediately when the warrant is executed the magistrate’s clerk shall make a copy of the warrant and the affidavit available for public inspection in the clerk’s office during normal business hours. A person may request the clerk to provide copies of the warrant and affidavit on payment of the cost of providing the copies.

I can't believe the JP issued a warrant, He must have not realized who it was. They are not exactly flight risks.
