A Harris County man shot in the head during an early-morning breakfast is suing IHOP, asserting negligence by employees at the Clear Lake Shores restaurant.

Houston-based attorney Gregory Cox filed the lawsuit Jan. 2 on behalf of Nickolis Peoples in the 56th District Court against IHOP Property LLC doing business as PropIHOP LLC, IHOP Restaurants LLC, International House of Pancakes LLC, Penta Investment Inc. doing business as IHOP #1947, RPAI Southwest Management LLC and the shooter, Paul Jesse Schonier, seeking more than $1 million in damages.

“At the moment of heel-strike, plaintiff felt insufficient coefficient of friction and/or slip-resistance between her foot and the floor, resulting in a sliding backwards, causing her center of gravity to be completely unsupported, which produced a severe imbalance and an eventual fall directly on her face and right knee,” the lawsuit asserts.

Insufficient coefficient of friction and/slip resistance blah blah blah blah. What lawyers won't do to avoid saying "She slipped and fell."

Sounds like she hired Professor Irwin Corey for her counsel.
