NOTICE CONCERNING FUTURE DISPOSAL OF PATIENT RECORDS

OF CERTAIN NEIGHBORS EMERGENCY CENTERS

Please be advised that you are receiving this Notice because you have been identified as a possible patient, family member, contact person, insurance provider or other representative of a patient who received treatment at NEC Texas City Emergency Center, LP (a “Closed Center”) located at 3302 Palmer Highway, Texas City, Texas 77590. If you are a family member or contact person of such patient, you are hereby directed to forward this Notice to such patient.

Neighbors Legacy Holdings, Inc. and certain of its affiliates (“Debtors”) filed bankruptcy cases in the United States Bankruptcy Court for the Southern District of Texas, jointly administered under Case No. 18-33836. On March 22, 2019, the Court entered its Order Approving Debtors’ Second Amended Disclosure Statement and Confirming Debtors’ First Amended Joint Plan of Liquidation of Neighbors Legacy Holdings, Inc. and its Debtor Affiliates Under Chapter 11 of the Bankruptcy Code (the “Confirmation Order”) [Docket No. 847], which confirmed the Debtors’ First Amended Joint Plan of Liquidation of Neighbors Legacy Holdings, Inc. and its Debtor Affiliates Under Chapter 11 of the Bankruptcy Code (the “Plan”). [Docket No. 772]. The Plan and Confirmation Order establish procedures for the retention and destruction of all patient records of the Debtors’ Closed Centers.

Pursuant to Section 351 of the United States Bankruptcy Code, 11 U.S.C. §§ 101-1532 and Article IX of the Plan, the Debtors are authorized to destroy all patient records at the Closed Centers 365 days after the date of this Notice.

In the interim, patients, their authorized representatives, or their insurance providers may obtain available patient records by contacting ScanSTAT Technologies, LP as set forth below. Please be advised that, to the extent you request patient records, you will be responsible for payment of a basic retrieval or processing fee pursuant to the Health and Safety Laws of your respective state, which include a charge per page copied and the actual cost of mailing, shipping, or otherwise delivering the copies to you or to your authorized agent.

All patient records of the Closed Centers may be obtained through ScanSTAT Technologies, LP, which handles all medical records requests pertaining to the Closed Centers. To obtain patient records, you may contact:
