BAYOU VISTA — A jury on Tuesday convicted a man accused of exchanging gunfire with a police officer a prosecutor said.

A jury of eight women and four men found Rodney Scott Smith 46 guilty of aggravated assault against a public servant stemming from a July 24 incident in the 800 block of Bonita in Bayou Vista prosecutor Reese Campbell said.

Neither Smith nor Bayou Vista police officer T.J. Krietemeyer were hurt. Krietemeyer was trying to detain Smith to learn whether he had a warrant prosecutor Jon Hall told the jury.

The defense claimed Krietemeyer had no warrant or reason to detain Smith and that Smith was the victim of an unreasonable search and seizure.

”When he didn’t want to get arrested he started shooting at a police officer” Hall told the jury. ”If you find him not guilty what you’re saying is any person not wanting to get arrested gets to start shooting at a police officer.”

The jury was expected to return today to Judge Lonnie Cox’s 56th District Court in Galveston to resume deliberating Smith’s punishment.
