GALVESTON — There’s no law against sniffing glue in Galveston. At least not in the city code, anyway.

A Twitter account calling itself @DumbestLaws and purporting to share unusual, but real, laws from around the world recently tweeted a message that said “Sniffing glue is illegal (Galveston, Texas).” It’s been retweeted 42 times and was presumably seen by many of the accounts 270,000-plus followers.

I did some quick checking of local ordinances and will, in the spirit of Politifact, rate the claim half true.

There is no law on the books prohibiting glue sniffing, according to city spokesperson Elizabeth Rogers, though there is a state law against the possession of inhalant paraphernalia.

A Google search leads to similar claims at other “stupid law” sites, some of them citing section 24-2 of the city’s code of law as its source.

But a look at current code reveals that there was once a section that pertained to model glue, but that was repealed on April 28, 2011.

The original law was apparently adopted in either 1960 or 1982. It read, in part, “No person shall, for the purpose of causing a condition of intoxication, euphoria, excitement, exhilaration, stupefaction, or dulling of the senses or nervous system, intentionally smell or inhale the fumes from any model glue.”

In April 2011, the city council struck that law from the code, along with a law that prohibited smoking in the council, because state laws had superseded it. 

In summary, there’s no longer a city law that prohibits glue sniffing, but only because it’s now illegal under state law.

Are freon and spray paint included in that category? Last time I bought spray paint at WalMart the register prompted the cashier for a DOB. And that was sometime this year.

Yes, abusable glue and aerosol products fall under the same statute as inhalent paraphernalia.
