In 2010, the Department of Justice published updated regulations under the Americans with Disabilities Act (ADA).  These regulations adopted the 2010 Standards for Accessible Design, which contain specific accessibility requirements for several types of recreational facilities, including swimming pools, wading pools and spas.

One requirement that will affect many businesses states that all public pools must be equipped with a lift. The compliance date is January 31 of this year, and Southern Comfort is here to help! They will be selling and installing lifts all over the Houston area, including Galveston and Harris counties.

This mandate, which includes all municipal, school, government owned and places of recreation and lodging, requires that there are at least two accessible means of entry. This includes pools in places such as hotels and motels, health clubs, recreation centers, public country clubs and more.

There are some exceptions to the rule, including pools less than 300 linear feet provided the means of entry complies with certain standards. Exceptions are also made for wave action pools, leisure rivers, sand bottom pools, and other pools where the user access is limited to one area.

If your pool is included in the mandate, Southern Comfort can help you easily meet the requirements! With Harmar’s commercial grade line of lifts, you can add one of their beautifully designed models to your pool. The lifts have comfortable seating, a seat belt, an ambidextrous design, and are engineered to have the smoothest, safest accommodations for your pool guests.

Your purchase of a pool lift product also might qualify you for a special tax incentive on your tax return. For individuals, the IRS allows you to deduct in full, as medical expenses, any home improvements and purchases made to accommodate someone in the family who is disabled.

As a business, two incentives are available to help cover the cost of making access improvements.  The first is a Disabled Access Credit that can be used for architectural adaptations, equipment acquisitions and services, and the second is a tax deduction that can be used for architectural and transportation changes.

Make sure your pool is in compliance by calling Southern Comfort today! If you have questions, feel free to give them at call at 409-621-1167 or stop by 2902 Avenue R ½  (just a block from the Seawall and 29th Street in Galveston).
